1. Agreement and scope
These Terms of Service govern access to AstraxisTech.com, VibeNomad, early-access services and related previews provided by Astraxis LLC. By using the service, you agree to these Terms. If you do not agree, do not use the service.
2. Product status
VibeNomad is being prepared for early access. Features, supported devices, connection methods, limits, pricing and availability may change. Preview features may be incomplete, experimental, interrupted or discontinued. Website information is not a promise that a feature will launch or remain available.
3. Eligibility and authorization
You must be legally able to enter a binding agreement. If you use the service for an organization, you represent that you are authorized to bind it. You may authorize only computers, devices, projects and accounts that you own or are legally permitted to access.
4. Accounts and credentials
Some features may require an account, authorized device or paired computer. You are responsible for accurate information, credential security and activity performed through your account or devices. Notify Astraxis promptly if you suspect unauthorized access.
5. Remote access responsibility
VibeNomad may allow you to view or interact with a computer, workspace, application, terminal or development environment. You are responsible for confirming that each remote action is authorized, appropriate and safe. Review and independently verify commands, builds, tests, deployments and generated artifacts. Keep backups and do not rely on a remote session as the only copy of important data.
6. Acceptable use
You must follow our Acceptable Use Policy. You may not access another person's device without authorization; bypass authentication or security controls; distribute malware; steal credentials; commit fraud; infringe privacy, copyright or other rights; interfere with the service; or attack, scan or disrupt another system.
7. User content and feedback
You retain rights in content you submit. You grant Astraxis the limited rights needed to host, process, secure, display and operate that content for the requested service. You represent that you have the necessary rights. Feedback may be used by Astraxis worldwide, permanently and royalty-free without compensation or attribution.
8. Intellectual property
VibeNomad, AstraxisTech.com, names, logos, software, interfaces, designs, documentation and other materials belong to Astraxis LLC or its licensors. You receive only a limited, non-exclusive, non-transferable and revocable right to use the service as intended.
9. Third-party services
The service may interact with third-party operating systems, networks, software, payment providers or other services. Their own terms and privacy notices apply. Astraxis is not responsible for third-party availability, security, content or compatibility outside our reasonable control.
10. Plans, subscriptions and payment
A pricing page does not create a charge or subscription by itself. If paid services launch, checkout will identify price, billing interval, renewal, cancellation, taxes and refunds before payment. Payment may be processed by a third party. Unless checkout says otherwise, fees are non-refundable to the extent permitted by law.
11. Privacy and security
Our Privacy Policy explains how Astraxis handles personal information. Do not submit credentials, private keys, payment details or sensitive source code through an unsafe channel. We may limit access when reasonably necessary to protect the service, users or third parties.
12. Availability and changes
We may modify, suspend, limit or discontinue the service for security, maintenance, legal, operational or product reasons. We do not guarantee continuous or error-free availability. We may update these Terms as the product evolves; continued use after the effective date means acceptance unless law requires another form of consent.
13. Disclaimers
To the maximum extent permitted by law, the service is provided "as is" and "as available". Astraxis disclaims warranties of merchantability, fitness, non-infringement, accuracy, availability and uninterrupted or error-free operation. Remote actions, generated code, builds, tests and artifacts require your review.
14. Limitation of liability
To the maximum extent permitted by law, Astraxis LLC and its officers, employees, affiliates, licensors and providers are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or lost profits, revenue, data, goodwill or business interruption. Total liability will not exceed the greater of the amount paid to Astraxis in the prior twelve months or 100 US dollars. Some jurisdictions do not allow these limits, so they may not all apply to you.
15. Suspension and termination
You may stop using the service at any time. Astraxis may suspend or terminate access for a violation, security or legal risk, non-payment or discontinuation. Intellectual property, disclaimers, liability limits and provisions intended to survive termination remain effective.
16. General terms
These Terms and incorporated policies form the agreement about the service. If a provision is unenforceable, the rest remains effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; Astraxis may assign them in a merger, acquisition, reorganization or asset sale. Governing law and dispute forum for a paid public release will be stated in the commercial terms before checkout. Mandatory consumer protections remain unaffected.
